Suing A Spouse For Fraud

Governor James McGreevy sued his wife, Dina, for divorce and she is claiming fraud. If a person believes they are marrying a heterosexual spouse and then the spouse, who knew he was gay continues to be gay but pretends to be straight, does the pretender commit fraud? I would say yes. It becomes a question of who knew what and when, doesn't it?

What do you think? Should people who knowingly enter a marriage being gay (when assumed straight), indebted (when assumed solvent), fertile (when assumed infertile) etc. be sued for fraud?

Should spouses who misrepresent themselves before marriage be sued for fraud?
