Big Bad Big Oil

Thomas Sowell says that when American's feel the financial pinch they need a villian and Big Oil fits the bill, but the Supreme Court didn't buy it--unanimously.

As an aside, is Judge Roberts able to build a cohesive view-point on the court (a few recent decisions have been unanimous) or are the cases brought so blatently obvious that the lower courts had serious cases of Cranial Rectumitous?
